This Isn't a Recession, It's a Planned Demolition

Credit is not flowing. In fact, credit is contracting. When credit contracts in a consumer-driven economy, bad things happen. Business investment drops, unemployment soars, earnings plunge, and GDP shrinks. The Fed has spent more than a trillion dollars trying to get consumers to start borrowing again, but without success. The country's credit engines are slowing to a crawl.

Fed chairman Ben Bernanke has increased excess reserves in the banking system by $800 billion, but lending is still slow. The banks are hoarding capital in order to deal with the losses from toxic assets, non performing loans, and a $3.5 trillion commercial real estate bubble that's following housing into the toilet. That's why the rate of bank failures is accelerating. 2010 will be even worse; the list is growing. It's a bloodbath.

The standards for conventional loans have gotten tougher while the pool of qualified credit-worthy borrowers has shrunk. That means less credit flowing into the system. The shadow banking system has been hobbled by the freeze in securitization and only provides a trifling portion of the credit needed to grow the economy. Bernanke's initiatives haven't made a bit of difference. Credit continues to shrivel.

The S&P 500 is up 50 per cent from its March lows. The financials, retail, materials and industrials are leading the pack. It's a "Green Shoots" bear market rally fueled by the Fed's Quantitative Easing (QE) which is forcing liquidity into the financial system and lifting equities. The same thing happened during the Great Depression. Stocks surged after 1929. Then the prevailing trend took hold and dragged the Dow down 89 per cent from its earlier highs. The S&P's March lows will be tested before the recession is over. Systemwide deleveraging is ongoing. The economy is resetting at a lower rate of activity.

No one is fooled by the fireworks on Wall Street. Consumer confidence is still falling. Everyone knows things are bad. Everyone knows the mainstream press is lying. The restaurants and malls are empty, the homeless shelters are bulging, and even the big-box stores have stopped hiring. The only "green shoots" are on Wall Street where everyone gets a handout from Uncle Sugar.

Bernanke has pulled out all the stops. He's lowered interest rates to zero, backstopped the entire financial system with $13 trillion, propped up insolvent financial institutions and monetized $1 trillion in mortgage-backed securities and US sovereign debt. Nothing has worked. Wages are falling, banks are cutting lines of credit, retirement savings have been slashed in half, and home equity losses continue to mount. Living standards can no longer be bandaged together with VISA or Diners Club cards. Household spending has to fit within one's salary. That's why retail, travel, home improvement, luxury items and hotels are all down double-digits. The money has dried up.

According to Bloomberg:

"Borrowing by U.S. consumers dropped in June for the fifth straight month as the unemployment rate rose, getting loans remained difficult and households put off major purchases. Consumer credit fell $10.3 billion, or 4.92 percent at an annual rate, to $2.5 trillion, according to a Federal Reserve report released today in Washington. Credit dropped by $5.38 billion in May, more than previously estimated. The series of declines is the longest since 1991.

"A jobless rate near the highest in 26 years, stagnant wages and falling home values mean consumer spending... will take time to recover even as the recession eases. Incomes fell the most in four years in June as one-time transfer payments from the Obama administration’s stimulus plan dried up, and unemployment is forecast to exceed 10 percent next year before retreating."

What a mess. The Fed has assumed near-dictatorial powers to fight a monster of its own making, and achieved nothing. The real economy is still dead in the water. Bernanke is not getting any traction from his zero-percent interest rates. His monetization program (QE) is just scaring off foreign creditors. On Friday, Marketwatch reported:

"The Federal Reserve will probably allow its $300 billion Treasury-buying program to end over the next six weeks as signs of a housing recovery prompt the central bank to unwind one its most aggressive and unusual interventions into financial markets, big bond dealers say."

Right. Does anyone believe the housing market is recovering? In the first 6 months of 2009, there have already been 1.9 million foreclosures.
The Fed is abandoning the printing presses (presumably) because China told Geithner to stop printing money or they'd sell their US Treasuries. It's a wake-up call to Bernanke that the power is shifting from Washington to Beijing.

That puts Bernanke in a pickle. If he stops printing; interest rates will skyrocket, stocks will crash and housing prices will tumble. But if he continues, China will dump their Treasurys and there will be a run on the dollar. What to do? Either way, the malaise in the credit markets will persist and personal consumption will continue to sputter.

The basic problem is that consumers are buried beneath a mountain of debt and have no choice except to curtail their spending and begin to save. Currently, the the ratio of debt to personal disposable income, is 128 per cent, just a tad below its all-time high of 133 per cent in 2007. According to the Federal Reserve Bank of San Francisco's "Economic Letter: US Household Deleveraging and Future Consumption Growth":

"The combination of higher debt and lower saving enabled personal consumption expenditures to grow faster than disposable income, providing a significant boost to U.S. economic growth over the period. In the long run, however, consumption cannot grow faster than income because there is an upper limit to how much debt households can service, based on their incomes. For many U.S. households, current debt levels appear too high, as evidenced by the sharp rise in delinquencies and foreclosures in recent years. To achieve a sustainable level of debt relative to income, households may need to undergo a prolonged period of deleveraging, whereby debt is reduced and saving is increased.

"Going forward, it seems probable that many U.S. households will reduce their debt. If accomplished through increased saving, the deleveraging process could result in a substantial and prolonged slowdown in consumer spending relative to pre-recession growth rates." ("U.S. Household Deleveraging and Future Consumption Growth, by Reuven Glick and Kevin J. Lansing, FRBSF Economic Letter")

A careful reading of the FRBSF's Economic Letter shows why the economy will not bounce back. It's mathematically impossible. We've reached peak credit; consumers have to deleverage and patch their balance sheets. Household wealth has slipped $14 trillion since the crisis began. Home equity has dropped to 41 per cent (a new low) and joblessness is on the rise. By 2011, Deutsche Bank AG predicts that 48 per cent of all homeowners with a mortgage will be underwater. As the equity position of homeowners deteriorates, banks will further tighten credit and foreclosures will mushroom.

The executive board of the IMF does not share Wall Street's rosy view of the future, which is why it issued a memo that stated:

Directors observed that the crisis will have important implications for the role of the United States in the global economy. The U.S. consumer is unlikely to play the role of global "buyer of last resort" — other regions will need to play an increased role in supporting global growth.

The United States will not be the emerge as the center of global demand following the recession. Those days are over. The world is changing and the US role is getting smaller. As US markets become less attractive to foreign exporters, the dollar will lose its position as the world's reserve currency. As goes the dollar, so goes the empire. Want some advice: Learn Mandarin.

Sagging Employment: A "recoveryless" recovery

July's employment numbers came in better than expected (negative 247,000) lowering total unemployment from 9.5 per cent to 9.4 per cent. That's good. Things are getting worse at a slower pace. But what's striking about the BLS report is that there's no jobs surge in any sector of the economy. No signs of life. Outsourcing and offshoring are ongoing, and downsizing the path to profitability. That's why revenues are down while profits are up. Businesses everywhere are anticipating weaker demand. The jobs report is a one-off event; a lull in the storm before the layoffs resume.

Unemployment is rising, wages are falling and credit is contracting. All the money is flowing upwards to the gangsters at the top. Here's an excerpt from a recent Don Monkerud article that sums it all up:

"During eight years of the Bush Administration, the 400 richest Americans, who now own more than the bottom 150 million Americans, increased their net worth by $700 billion. In 2005, the top one per cent claimed 22 per cent of the national income, while the top ten per cent took half of the total income, the largest share since 1928.

"Over 40 per cent of GNP comes from Fortune 500 companies. According to the World Institute for Development Economics Research, the 500 largest conglomerates in the U.S. "control over two-thirds of the business resources, employ two-thirds of the industrial workers, account for 60 per cent of the sales, and collect over 70 per cent of the profits."

In 1955, IRS records indicated the 400 richest people in the country were worth an average $12.6 million, adjusted for inflation. In 2006, the 400 richest increased their average to $263 million, representing an epochal shift of wealth upward in the U.S." ("Wealth Inequality destroys US Ideals" Don Monkerud, consortiumnews. com)

Working people are not being crushed by accident, but according to plan. It is the way the system is designed to work. Bernanke knows that sustained demand requires higher wages and a vital middle class. But Bernanke works for the banks, which is why the Fed's monetary policies reflect the goals of the investor class. Bubblenomics is not the way to a strong/sustainable economy, but it is an effective tool for shifting wealth from one class to another. The Fed's job is to facilitate that objective, which is why the economy is headed for the rocks.

The financial meltdown is the logical outcome of the Fed's monetary policies. That's why it's a mistake to call the current slump a "recession". It's not. It's a planned demolition.

MANMOHAN SINGH - CONSPIRACY THEORIST ?? . . . OR WORSE !!



So the lies & the misinformation campaign continues unchallenged for the most. But the issues raised by the PM are of immense significance to the 26/11 Mumbai terror attacks & for those of us who have been challenging the state & the police version.

Yesterday we had the papers screaming out the headlines where we had PM Manmohan Singh saying the following:

1) "There is credible information about ongoing plans of terrorists in Pakistan to carry out fresh attacks".

2) That the threat "covers all parts of the country".

3) That the warning was based on "intercepts & chatter among top terrorists leaders including 26/11 accused & front ranking LeT opeartives Lakhvi, Zarar Shah & Abu al Qama".

4) The PM also refers to Let's local collaborators & the disarray within the Indian Mujahedeen.

All very good, I must say. The only point is that I wish the PM had made this speech by the end of Sepember or October or after November 19, 2008 when he & MK Narayanan (National Security Advisor) were given a comprehensive dossier by the RAW, which clearly pointed at the coming terror attack.

The PM should have told us that they had evidence in the form of taped conversations, including those very mentioned above. The PM should have told us that the RAW had tapped into their very satellite phones & we knew that an attack was coming.

For expample, by September 14, the RAW was aware of the specific targets & by September 18, even the timing, that the terrorists would strike Mumbai between 9-11pm was also known. Remarkably, a RAW spyplane was also photographing it as well, whilst it was following the Al-Husseini as it left from Karachi.

To me it clearly appears that this entire operation was being monitored !! Dosen't it to you as well ??

And they call it 'intelligence failure' !! What a shame & a sham !!

The PM should have told us that our new found friends in the CIA had also warned us in September. Remarkably the CIA with its largest operation & operatives now based in Pakistan, did not inform the Pakistani political or military leadership or that of it's cronies in the ISI, whose salaries they pay !!

Recall the fact that Mahmud Ahmad, the then chief of the ISI had to resign from his job, why ?? because he had wire transferred $100,000/- to Muhammad Atta, the suppossed mastermind of the 9/11 terror attacks. Mahmud Ahmad is amongst the closest friends of George Tenet, who was then the chief of the CIA. On 9/11, Mahmud Ahmad was in D.C. sipping coffee with Tenet. That is how the CIA used it's ISI connections to plan, fund, employ, train & aid in the execution of 9/11.

Get what we are saying ??

Back to 26/11, the PM should have told us that they were following the 'chatter between Lakhvi & his terror operatives' over a period of 10 to 11 months prior to 26/11.

On the matter of sleeper cells of the LeT& local collaborator, the Manmohan Singh government & his Home Minister, Mr. Chidambaram would have us believe that the 10-12 terrorists who attacked Mumbai had no local help whatsoever. They arrived upon this conclusion a day after the attack was wound up.

Unbelievable but true !!

And all the secular liberals heaved a sigh of relief as then Muslims would not be rounded up in their thousands as was the case during the Mumbai Train terror attacks of July 11, 2006. (That was also the day when Israel attacked Lebanon . . . . . & that was not a coincidence)

Firstly no sane person believes in this country or the world over is willing to believe that a mere 10 to 12 people could resort to this sort of mayhem over 4 different centres & ward of the Indian security forces for 3 days. This is a big fabricated lie !! And the government continues to promote this absurd & nonsensical version.

In our studied estimation, this terror operation was waged by at least a minimum of 50-60 terrorists, who were part of this operation further aided by a team of local collaborators.

This is elementary - my dear PM . . . . or to whomsoever it may concern . . . !!

The PM also refers to "local cells of the LeT". Now comes the interesting part.

The Manmohan Singh regime has maintained that there was no local cells active during the entire 26/11 terror attack. And now he tells us that that local cells, who are in a disarray because of the crackdown after 26/11 are a threat.

So Mr. PM, just three questions:

a) Were the local sleeper cells not around prior to 26/11, or have they appeared after the event ??
b) If they were there, would not they have helped in the entire 26/11 episode, especially prior to the attack ??
c) Or were the sleeper cells 'sleeping' or maybe 'hibernating' during this period ??

In our assessment & again this is simple to discern, the terrorists had local collaborator cells, without which this operation would have been impossible, both from the perspective of local intelligence & the logistics required at every step.

Then who constituted these cells is the moot point.

Our inference leads us to believe that the local help emerged from both
A) The sleeper cells of the Abhinav Bharat terror network, that includes their sympathizers across the security spectrum.
B) From the entire network of private security agency operatives trained by the Israeli MOSSAD & they number in a few lakhs.

And thus the conspiracy of silence !!

The point is that, like the American people & their intelligentsia who have successfully challenged the 'conspiracy theory of their governments' on the 9/11-WTC attack, we to need to wake up & challenge our Sarkar & it's perfidious lies. (A dozen Arab guys with box cutters, hijacked the planes & even though they could barely fly Cessna's, they maneuvered their Jumbo's into the towers, give me a break or maybe a better conspiracy theory)

Clearly the Manmohan regime is not only lying but also hiding certain facts that can lead us to uncovering the 26/11 terror plot. If not, then at least the government should have released the 'Ram Prahdhan Committee Report' to the general public & the media for our perusal. Even this report with it's very limited mandate has been buried under the burden of 'national security'.

As we have repeatedly stated, the findings of the Interpol are very important. But who is invited to the Indian courts to give evidence - the F.B.I. !! And not a whimper of protest from any quarter. The politics & strategy of deploying & orchestrating false flag terror ops, has neutralised many a mind into challenging the collusion of the state with Imperialist organizations such as the CIA, FBI or the MOSSAD for that matter.

The Interpol has mentioned that the 26/11 terror attacks were planned across 7 countries. The Interpol also complained that the Indian authorities were not very forthcoming in sharing intelligence inputs. I wonder why ??, actually I do not !!

Seven & not one or two, Mr. PM.

And the PM & Mr. Chidambaram continue to deny the need for a "National Judicial Commission of Inquiry into the Mumbai 26/11 Terror Attacks".

This sort of manipulation was not even indulged Mr. Bush (of the Shoe fame).

Even at the time, when Mr. Richard Holbrooke (a Hillary Neocon) was last down in New Delhi, Manmohan was out there blaring away that 30 Taliban had entered Kashmir. At the very same time his very Home Minister Chidambaram, as well as the Chief Minister of J&K Mr. Omar Abdullah were denying the same on the basis of 'intelligence reports'.

The fact is that our PM is a seasoned liar and he is far more Obama-like than even Obama.

He & the leading members of the cabinet are ideologically committed to the American-Israeli-European project for the region & India has been reduced to a junior partner in the Imperial gameplan for the region.

Instead of challenging the Empire & it's growing presence in South Asia & all of Asia, we are collaborating with their designs to redraw the strategic map of Asia, one in which the US & it's allies seek to dominate in every sphere of our existence.

Both Mahatma Gandhi, Pandit Jawaharlal Nehru as well as Indira Gandhi must be shedding tears as they see their nation betraying the Third World and sitting in the White Anglo-Saxon Zionist camp.

Thus the need for a sustained national struggle against the Imperialist onslaught on the Asian nations, in solidarity with the peoples of Africa & South America.

In any case the truth will prevail, it always does, it takes time, but it always does.

The unjustified use of Section 151 of CrPC to detain people in the guise of potential threat, came under the scanner of Bombay High Court on Thursday.

On a petition filed by two activists against their illegal detention during Hillary Clinton's visit, the Court made it clear that the police cannot interfere with the liberty of an Indian citizen when some American dignitary visits the country.

The division bench of Justice Bilal Nazki & Justice A. R. Joshi on Thursday stated thatthere was a "question of Self-Respect of India as a Nation". Feroze Mithiborwala of Awami Bharat & Aslam Ghazi of Jamat-e-Islam-e-Hind had filed the petition.

After going through Section 151, which states that that the police should know of a design to commit some offence, Justice Nazki felt that there was a need to go further into the interpretation of the Section & appointed advocate N.N. Gawankar as amicus curie to assist in the case.

"Why should we punish our own citizens", he asked. "If an American citizen comes, our citizens is behind bars."

The Judge said the police can detain anybody if the Court accepted their interpretation. "You can take us also," he added.

When additional public prosecutor Dinesh Adsule argued that that the activists were detained as they were planning some demonstration, the Court retorted that this is an independent country & demonstrations are permitted in India.

The Court later adjourned the hearing for a week.

'Police are not nawabs, they must follow rule of law'

MUMBAI: The Mumbai police got a dressing down in the Bombay high court on Thursday.

Rapping the MIDC police for illegally detaining two activists a day before US Secretary of State Hillary Clinton visited the city, the HC said the police "must not act like nawabs. This is a democratic country and they have to follow the rule of law''.

A bench, headed by Justice Bilal Nazki, directed the police to file a detailed affidavit, explaining the basis of detaining activists Feroze Mithiborewala (41) from Andheri and Aslam Ghazi (57) from Kurla for more than 20 hours. "Today, you picked them up and tomorrow, it could be others,'' the judges said, disapproving of the hasty "preventive'' action by the police. "What was the material for a cognizable offence before the detention?'' asked Justice A R Joshi, the other judge.

Mihir Desai, counsel for the activist, said the issue was of larger malaise that afflicted the police force. His submission was that despite Supreme Court guidelines on arrests, people are picked up indiscriminately and often without any record. In this case, the activists have support from several quarters and lawyers, including Gayatri Singh who had protested against the act, insist on getting a written acknowledgement. "But usually, people who do not have a voice or means to engage a lawyer, suffer quietly,'' Desai said.

Mithiborewala was picked up from his Andheri home on the night of July 17, by two plainclothesmen, who did not give him any reason for the act. He was let off next evening.

DCP KMM Prasanna, who on Thursday was asked to investigate an alleged fake encounter case afresh, has been named as respondent by Mithiborewala in his petition, as he was then the local DCP. The petition has sought an inquiry into the police action and disciplinary action against Prasanna and another officer for not giving any reason for the detention.

On this very day, from August Kranti Maidan, from our beloved city of Mumbai, 67 years ago, Mahatma Gandhiji gave a clarion call and demanded that the "British Empire Quit India". It was a call that was heeded by millions of Indian people and it galvanized the masses into a new patriotic fervour, finally sounding the death knell of the Empire.


Our National Independence Movement not only liberated our nation, but also proved to be of great hope and inspiration for all oppressed nations across the world.


India emerged as a sovereign, democratic, secular republic, committed to the values of social & economic equality & political empowerment. We led the world in the vision of Mahatma Gandhi, Pandit Jawaharlal Nehru, Dr. Baba Saheb Ambedkar, Maulana Abul Kalam Azad, Bhagat Singh and Ashfaqullah, to name only a few of those great souls who sacrificed their lives to liberate the nation.


We created the Non-Aligned Movement (NAM), where the Third World Nations could unite to counter imperialist hegemony.


But alas, after 1990, as the global geo-political balance began to change, the world once again began a prey to American Imperialism as well as a new menace in the form Israeli Zionism. The forces of Imperialism & Zionism found their allies in the Brahmanical elite within the Congress & the BJP-RSS. The new international Corporate oligarchy also found allies within the Indian corporate elite. The alliance was complete !!


We then saw imperial wars unleashed on Afghanistan, Iraq & Somalia, with continous threats to Venezuela, Cuba, North Korea, Iran & Syria amongst others. The American-Israeli-Nato Military Industrial Complex was on the rampage.


Worse, the Indian political & corporate elite chose to support & reduce India into becoming a junior partner of the American project as was evident in the signing of the Indo-US Nuclear Deal. Certain components of the agreement in the Hyde Act & the 123 Agreements compromise our very sovereignty & security. We have now basically a part of the US-Israeli orbit and thus a satellite state.


In the last two decades, the International weapons trade has crossed the 1.5 trillion dollar mark and the private security industry is also growing. This has happened not due to the threat of wars, but due to the threat of terror. The Global terror network is being created & financed by the US & Israeli's to unleash terror and then it is under the garb of fighting the global war on terror that they penetrate nations & wage wars. This was exactly the strategy deployed during the 9/11 WTC terror attack, after which the Americans attacked Afghanistan & later Iraq.


India and all of South Asia as well as Asia are under attack. The western powers are aware of the fact that they need to weaken the Asian nations to maintain the present global order dominated by them.


Thus it is the responsibility of the Indian masses to wage a struggle against the US-Israeli Imperial agenda.


Today, we also call for the "Boycott of Israel".


Opposition to Israel & support to the cause of Palestine has been a part of our historical legacy. The Palestine-Israel conflict lies at the centre of geo-politics and we, the people of India need to pro-actively support the Palestinian people in their quest for a nation of their own.


Israel is the most dangerous nation in the world. It is a recorded fact that Israel promotes terror and a large number of the American people are now aware that the Israeli MOSSAD along with the American CIA planned and executed the 9/11 WTC terror attack.


Israel, like White South Africa, is a Colonial-Settler State, that oppresses the Palestinian people, who are the original people, who have lived on that land for more than 5000 years.


Israel is also responsible for spreading terror & killing innocents in India & it has been central to the training of the "Abhinav Bharat" terror organization.


Similarly, the Americans have destroyed Pakistan & Afghanistan, by creating terror organizations.


Thus the solution is for:


1) The Indian people to realise & thus undertake their historical responsibility.
2) To wage a united struggle with all the South Asian nations to free the region & thus create a South Asian Union.
3) To support & unite all the nations in Asia, Africa, South & Central America against the American-Israeli-European project.


We thus appeal to all nationalist & patriotic Indians to heed the call and join the struggle against US-Israeli Imperialism and safeguard our sovereignty & security as well as that of the world.

Matan has been one of the founders of the "Refusenik" anti-Militarist movement. He is also the leader of the "Students for Justice for Palestine" in Hampshire College (USA), which was amongst the first to divest from Israel.

There is a clear attempt to both subvert and finally scuttle the investiagtions into the Abhinav Bharat terror network. It is also a clear manifestation of the double standards and the hypocrisy of both the national & state governments, the judiciary as well as the security apparatus led by the Anti-Terror Sqad (ATS).


After the 26/11 Mumbai terror attacks, we were truly worried about the course of the investigation against the Abhinav Bharat, that was being led by the late Shri Hemant Karkare, the ATS chief. His chargesheet was immaculately drafted and the case against the Abhinav Bharat was impregnable. We had also stated that his successor, Mr. Raghuvanshi, could not be trusted with the investigation and we have been vindicated. Raghuvanshi has not proceeded with the investiagtion and it is now clearly being subverted by a number of political pressures. We demand that Raghuvanshi be asked to resign and an honest & upright officer be appointed as the new ATS chief.


It should also be made clear that we are against the use of MCOCA in principle, as it is a draconian anti-democratic law that is in clear violation of all contitutional and democratic principles. Also its selective and communal implementaion is abominable to the secular and democratic nature of our society.


Our main objective is to make sure that the investiagtion as well as the legal process, into the Abhinav Bharat terror organization carries on unimpeded and the links & its deep roots in the various bodies of the Rashtriaya Swayamsevak Sangh, elements of the Military and the intelligence services, as well as the fact that they have deep ties with the Israeli MOSSAD, be exposed.


We have received support from all major political parties & secular organizations. We appeal to all concerned patriotic citizens to join the protest and raise our collective voice against the politics of terror that has been unleashed by the powers that be.

Court drops anti-terror provisions against all Malegaon accused



Mumbai In a jolt to the Maharashtra Anti-Terrorism Squad (ATS), the special court hearing the 2008 Malegaon blast case today dropped provisions of the stringent anti-terror Maharashtra Control of Organised Crime Act (MCOCA) slapped on Sadhvi Pragyasingh Thakur, Lt. Col. Prasad Purohit and nine others accused.
The reasoning behind the ruling by Special Judge Y D Shinde is expected to be available on Saturday.

The judge stayed his order for four weeks to allow the prosecution to appeal in the High Court. If the ruling is upheld by the Bombay High Court, the high-profile case will be tried in a regular court in Nashik and not the special MCOCA court in Mumbai.

While the ATS and the prosecution said they would appeal, lawyers defending the Hindu activists hailed the ruling and said it showed that MCOCA had been applied in the case only to use confessions of the accused during the trial as the state had hardly any evidence to back its case.

Purohit’s lawyer Shrikant Shivde had challenged the application of MCOCA in the case saying the ATS investigation had not established that the accused were operating as part of a syndicate as required by MCOCA. They were also not alleged to have gained financially.

MCOCA can be applied in a case only if at least one of the accused has two prior cases that have been chargesheeted within the past decade. Further, each offence must be punishable with a minimum sentence of three years or more.

The tough law allows the prosecution to use as evidence confession recorded by a senior police officer which is ratified in court within 24 hours while under the Indian Penal Code a confession can only be recorded before a metropolitan magistrate. Besides, MCOCA also allows the prosecution to use telephone intercepts as evidence.

The ATS had applied MCOCA in the September 29 bomb blast case — in which six Muslims were killed — after one of the accused, Rakesh Dhavde, an antique arms trader from Pune, was found to be linked to three other criminal cases as well. While Dhavde had been chargesheeted in one of the three cases, which related to a blast in Purna, before he was picked up for the Malegaon blasts, he was charged for the two other older cases after he was picked up for Malegaon. This allowed the ATS to impose MCOCA on him and — by extension — on the others accused in the case.

However, Shivde argued against this saying the cases against Dhavde did not meet the criteria for MCOCA as he was chargesheeted in the second and third case only after being picked up for the Malegaon blast. His case got a boost last week when Dhavde was discharged in the Purna case for want of evidence.

“On the basis of one accused Rakesh Dhavde and chargesheets against him, the ATS can’t pull in others. They have nowhere been able to produce independent evidence against the accused besides the confessions extracted,” said Shivde. “We have maintained from the beginning that MCOCA was invoked just to extract confessions. The police resort to such moves when they have no evidence against the accused.”

Special Public Prosecutor Rohini Salian said Friday’s order had not deterred the state. “We have enough evidence to challenge the order. With 11 accused tried in the case, we have provided all the evidence in the chargesheet to establish how this was a large nexus and a syndicate was operating under the disguise of an organisation ‘Abhinav Bharat’. Enough telephonic conversations and forensic reports are furnished to support our stand,” she said.

The case had assumed strong political overtones due to the involvement of Hindu extremist groups and Friday’s ruling once again drew political attention. The BJP’s Mumbai unit president Gopal Shetty said that “the quashing of MCOCA proves that it was a clear conspiracy hatched against innocents to appease the minority community. Congress slapped MCOCA on them just to gain political mileage. And Congress made use of the ATS in the case”.

Also do read the latest book by David Ray Griffin that states that Bin Laden died way back in 2001 Dec 15 . . . odd. Some one should tell Obama that, or he to will be wasting his time and land up killing a few million more than his predecessor George-the-murderer-Bush.

In third week of July (2009) Maharashtra police arrested several Muslims in Pusad, Akola and neighboring regions on the charge that they are reviving SIMI under a new name. It is after a fairly long time that one has heard of arrests in the name of SIMI. The earlier cycle of arrest of Muslim youth which was a matter of routine after every blast, Malegaon, Mecca Masjid in Hyderabad, Jaipur and other places was broken with the impeccable proof of Sadhvi Pragya Singh Thakur’s motor cycle being found in Malegaon. The trace of motorcycle link led to Swami Dayanand Pandey, Lt Col Shrikant Purohit and many others associated with Hindu right wing organizations, offshoots of or inspired by RSS ideology.



Society witnessed that after most of the blasts so far, Muslim youth were arrested on the charge of being behind the blasts, were harassed for months and then released for the lack of evidence. This was more or less a routine pattern and it frightened the whole Muslim community to no end. Many a Muslim youths’ careers were crushed due to these reckless and baseless arrests. Many a minority families under went severe problems, were ostracized from their own community once they were dragged into the net on the charges which were guided more by the prevalent biases or stereotypes than any substance. SIMI came to be regarded as the core organization responsible for fomenting trouble through youth. Despite the ban on SIMI in 2001, the Muslim youth kept on being labeled as SIMI activists and were put behind the bar.



It’s not to say that SIMI was holding ideology which was talking of democracy and secularism. One knows that SIMI, which began as a student front of Jamat-e-Islami Hind gradually, came out of its control and became radical in the decade of 1990s in particular. Yoginder Sikand, an Islamic scholar of repute gives a very crisp history of this organization (/www.countercurrents.org/comm-sikand150706.htm). SIMI was founded on the ideology propounded by Maulana Maududi, according to whom all non Muslims are kafirs and man made systems like democracy are false and Shariah is the only way. It kept the goal of spreading Islamic consciousness amongst Muslim students and peaceful missionary work amongst non Muslims. Some events in the decade of 1990 were to shape its ideology in a radical and militant direction. These events were Soviet Russia’s invasion of Afghanistan and Islamization of Pakistan in particular.



Meanwhile Jamat- e- Islami came to accept democracy and Secularism as its guiding ideology. SIMI came out from the control of its parent organization to talk in a different language. The demolition of Babri Mosque and the post demolition violence gave it a fillip in the negative direction. It said that Democracy has failed to protect Muslims so there is a need for some one like Mohammed Gazni, the destroyer of Somanth. This was also the theme of the poster released by them in the aftermath of Babri demolition. It was alleged that SIMI has links with Sikh and Kashmiri militants. It was alleged that they have links with Osama and ISI. At the same time SIMI claimed that it wants to work through peaceful methods, while the worsening communal situation made it to say that Muslims are a belabored community. Under these circumstances SIMI was banned in 2001.



The ban on SIMI was challenged, so a tribunal had to be appointed to review the ban. Ajit Sahi of Tehelka in his painstaking investigation, followed the tribunal’s sitting all through (Tehelka, SIMI Fictions, 12th August 2008), the tribunal did not find any evidence of the charges put against the organization for banning it. The ban could not be upheld. About this investigation Ajit Sahi said, “… his investigation is no dry story rising from lifeless court documents. It has been an emotional rollercoaster to sit across young boys barely into manhood, their foreheads creased by sleepless nights worried stiff over the jailing of a father, a brother, wondering endlessly, “Will this end? Is this for real? What do I do now? Where do I go now? Will I survive this?” He further says “as I interviewed countless Muslims, so weathered, I couldn’t but ask myself, What if this was me? What if it was my brother, my father in jail?”



With the World scenario tilting against the Islam and Muslims, courtesy the radical Islamists trained in the Madrassas set up in Pakistan with US aid, the popular psyche perceived an average Muslim as a terrorist and police machinery operated on this understanding. Even when scores of lives were shattered and the community came under the intimidation of highest order, the Government did not put any corrective to this pattern of investigation with which police was pursuing its work.



Disturbed by this situation two people’s tribunal were set up by the Human Rights groups. The report and recommendations of both the tribunal are similar and overlapping. The first one was headed by Justices (Retd) Bhargava and Sardar Ali Khan, with prominent social activists like Asghar Ali Engineer and Prashant Bhushan as the jury. The testimonies showed that a large number of innocent young Muslims have been and are being victimized by the police on the charge of being involved in various terrorist acts across the country. This is particularly so in Maharashtra, Gujarat, Madhya Pradesh, Andhra Pradesh and Rajasthan, though not limited to these States. This victimization and demonisation of Muslims in the guise of investigation of terror offences, is having a very serious psychological impact on the minds of not only the families of the victims but also other members of the community. It is leading to a very strong sense of insecurity and alienation which may lead to frightful consequences for the nation.



The second tribunal set up by different set of organization s of Rajasthan worked under the leadership of Justice (Retd) Bhargava. One of it pertinent observation was that the police authorities investigating the terror offences appear to be violating all the laws of the land and directions of the Supreme Court during the conduct of the investigations. In particular, many persons have been detained for days or weeks, without showing them to be arrested and without producing them before any Magistrate. They have been sometimes tortured and humiliated by the police officers. They have not been allowed to meet their relatives and lawyers, who have often not even been informed of their detention. The investigation of the blasts by the police also appears to be communally motivated and only persons belonging to the Muslim community have been the target of the investigations.



The names of HUJI and SIMI have been bandied about by the police as the perpetrators of the blasts without any evidence. A number of former members of SIMI have been arrested and detained without any basis or evidence against them. The media has also been uncritically repeating and amplifying the baseless allegations and innuendoes of the police mentioning persons and organizations belonging to the Muslim community, thus resulting in ethnic profiling and feeding into the Islamophobia being sought to be created and reinforced in the minds of the Hindu community by the Hindutva organizations. In Jaipur this has resulted in the vilification of the entire Bengali Muslim community who has been victimized by the Hindutva organizations in complicity with the police.



Thousands of them have been picked up after the blasts and forcibly transported to New Jalpaiguri and then Bangladesh without any due process of law and without giving them an opportunity to show their Indian Citizenship. This has resulted in the ethnic cleansing of Jaipur.



One does not know with what seriousness the administration looks at these people’s tribunal, the fact is they have put forward profound realities of the society. It is imperative that the Government takes a serious look at these reports and instructs the investigation authorities to be more professional in their approach and sheds its biases while dealing with minority community.

This is cause for serious national concern. Day by day we see the ATS, now led by Raghuvanshi, dithering on following the investigation carried out by it's former chief, the late Shri Hemant Karakare, who was a victim of the 26/11 terror attacks.


Now even the courts are being manipulated to protect Sadhvi Pargya & Lt. Col. Purohit.


This was expected, as well as predicted by those of us who had stated that part of the strategic agenda or rather the sub-plot behind the 26/11 attacks was to scuttle the investigation into the Hindutva terrorist networks that went deep into the RSS and the BJP, as well as sections of our Military-Intelligence and police apparatus.


We stand further vindicated in our position. There is a need for a national outcry against this outrageous judgement of the court as well as the role of the police and the ATS. This, in our estimation is not possible without the tacit approval of the national political leadership of the Congress and the BJP.

In a reprieve to sadhvi Pragya Singh Thakur, Lt Col S P Purohit and nine other accused in the 2008 Malegaon bomb blast case, a special court today dropped provisions of the stringent Maharashtra Control of Organised Crime Act (MCOCA) invoked against them saying none are part of an organised crime syndicate.


Designated Judge Y D Shinde, presiding over the special MCOCA court here, however, rejected the bail plea of Purohit.


The court dropped the charges in this case while hearing the bail plea of Purohit who had challenged invoking this stringent act. Shinde observed that none of the accused are part of the organised crime syndicate.


He also observed that none of the accused had more than one charge sheet filed against him or her -- a prerequisite for invoking provisions of MCOCA.



As provisions of IPC would apply now, the case would be heard by a sessions court in Nashik.

The special court, however, stayed its order lifting MCOCA provisions for a period of four weeks to enable the state to file an appeal in Bombay High Court.



Additional DGP K P Raghuvanshi said the government would file an appeal in the high court after getting certified copy of the order.



Seven people were killed in a bomb blast on September 29, 2008 at Malegaon, a textile town near Nashik.
